508 Incorporation F.A.Q.

GENERAL UNDERSTANDING

What is a 508(c)(1)(a) organization?
A 508(c)(1)(a) organization is a religious, nonprofit auxiliary that is automatically tax-exempt under U.S. law and not required to apply for 501(c)(3) status or file annual returns with the IRS. This applies to churches, their integrated auxiliaries, and associations of churches — including Moorish American auxiliaries.


How is this different from 501(c)(3)?
501(c)(3) requires formal IRS application and ongoing annual reporting. 508(c)(1)(a) entities — if structured properly — are
automatically exempt and do not have to apply or report. You give notice, not request approval.


Do I need a lawyer or accountant to use this toolkit?
No. This toolkit is designed for self-directed Moorish Americans who want to start or restructure their business as a religious auxiliary. Two rounds of document review are included for guidance, but you do not need legal counsel to complete or file the documents.


What kinds of organizations qualify as 508 religious auxiliaries?
Any organization operating in support of a recognized religious body (such as the Moorish Science Temple of America), that functions to uplift, educate, and serve the public through charitable, cultural, or religious work.

What’s the first thing I should do with the Toolkit?

508 Incorporation Roadmap and the Course Introduction. Then follow the steps in the order they’re laid out — starting with applying for your EIN.


Can I use these documents to restructure my existing business?
Yes, but there may be additional steps depending on how your current entity is formed. If you already have an LLC, corporation, or other structure, email

What’s included in the document review service?

How do I submit my documents for review?
Email your completed PDFs to certified@califamedia.com with the subject line “508 Toolkit Document Review – Round 1” or “Round 2” as needed.


DOCUMENT QUESTIONS

Do I have to file anything with the IRS?
No. You
notify the IRS of your status using the included Notice of 508 Status. This is not a request for approval, but a declaration of your exempt status as a religious auxiliary.


What if my state doesn’t recognize 508(c)(1)(a)?
Your state doesn’t need to “recognize” the 508(c)(1)(a) status. They process
Articles of Incorporation under nonprofit law. After approval, you may submit the Request for Tax Exemption Certificate to your state’s revenue agency.


What if the bank doesn’t understand this setup?
Use the
Corporate Banking Resolutions included in the toolkit. Identify your business as a religious nonprofit auxiliary, not as a “508 corp.” Most banks are familiar with nonprofit paperwork — use terms they understand.


When should I file my Notice of 508 Status?
Either:

  • After filing your Articles and receiving confirmation
  • Or after applying for your state tax exemption
    You’ll send the Notice with
    tracking to both the IRS and your Secretary of State.


How do I prove my tax-exempt status?
You may use:

  • Your filed Articles of Incorporation showing nonprofit religious purpose
  • Your Notice of 508 Status with proof of delivery
  • Your State Tax Exemption Certificate if approved


TECHNICAL OR STRATEGIC

Can I get a 508 letter from the IRS for verification?
No. The IRS does not issue determination letters for 508(c)(1)(a) religious auxiliaries. You are automatically exempt by law and protected under IRS Code §508 and §6033.


Do I still need to file IRS Form 990?
No. As a religious auxiliary, you are
mandatorily exempt from IRS annual filing requirements under §6033(a)(3)(A)(i).


Can I use a PO Box or virtual address for my business?
The IRS requires a
physical address to issue an EIN. Many use a UPS store mailbox or similar services that provide a street address. Once your EIN is issued, you can list a mailing address separately.
